Welcome to Blysko, an online platform connecting beauty specialists with clients seeking services. These Terms and Conditions govern your use of our platform, whether as a Specialist, Client, or visitor. By using Blysko, you agree to be bound by these Terms.
1. About Blysko
Blysko is operated by the future legal entity behind the Blysko platform, which will be registered in Switzerland. Until formal registration is completed, the platform is being prepared and operated in pre-launch capacity.
Blysko offers a web-based software for online appointment booking and customer management (hereinafter "Software") for small and medium-sized companies on the website www.blysko.com.
2. User Roles
There are three parties involved:

Specialists:
Independent beauty service providers who manage their profiles, availability, and bookings.

Clients:
Individuals who browse specialist profiles and book services.

Blysko:
The platform operator providing the digital infrastructure for both parties to interact.
3. Eligibility
You must be at least 18 years old to use Blysko. By registering, you confirm that you are legally capable of entering into a binding agreement.
4. Account Registration
Agreement to Terms
By creating a Specialist profile on Blysko, selecting a subscription plan, or using any part of the Blysko platform, you agree to be bound by:

These Terms and Conditions;

The details and features associated with your selected subscription plan, as described on the Blysko website at the time of registration; and

Any applicable platform policies (e.g., privacy policy, acceptable use policy).
Together, these documents represent the complete and binding agreement between the parties. No other verbal or written communication, proposal, or representation shall be considered part of the Contract unless expressly incorporated in writing.
Definition of Contract
The legally binding agreement ("Contract") between Blysko and a user consists of: (i) these Terms and Conditions, (ii) the selected subscription plan and its features as listed on the Blysko website at the time of registration, and (iii) any applicable platform policies such as the Privacy Policy.
Conclusion of the Contract
A binding contract between the Specialist and Blysko is formed when the Specialist selects a subscription plan and completes the registration process on the Blysko platform. By doing so, the Specialist agrees to the applicable service terms, pricing, and features associated with the selected plan, as outlined on the Blysko website.
The contract is concluded without the need for a physical signature or separate confirmation. Use of the platform following registration constitutes acceptance of these Terms and the subscription agreement.
Account Creation

All users must provide accurate and complete information during sign-up.

Specialists are responsible for maintaining the confidentiality of their account credentials.

Blysko reserves the right to suspend or terminate accounts for violations of these Terms.
5. Booking and Payments

Clients can book services directly through a Specialist's public profile.

Payments may be processed via third-party payment providers. Blysko is not responsible for payment processing issues.

Cancellations and rescheduling policies are set by the individual Specialists. Clients are advised to review those before booking.
6. Subscription Plans
Blysko offers several subscription plans with varying features, service levels, and support options. The full details of each subscription plan, including pricing, features, and any applicable usage limitations, are listed on our website at: https://blysko.com/en#pricing.
By selecting a subscription plan and completing registration, the Specialist agrees to the terms, pricing, and feature set of that plan. The subscription becomes active immediately upon successful registration and payment.
Subscription fees are billed in advance, either monthly or annually, based on the chosen billing cycle. All subscription plans renew automatically unless canceled before the end of the current billing period. Cancellation can be managed by the Specialist via contact support. Refunds are not issued for partial use of a billing period.
Blysko reserves the right to update subscription plan features, fees, or support offerings. Changes will take effect in the next billing cycle and will be communicated in advance when required.
7. Specialist Responsibilities

Specialists are solely responsible for the services they offer, including pricing, availability, and service quality.

Specialists must comply with local regulations, including licensing, insurance, and hygiene standards.

Misrepresentation or failure to deliver services as promised may result in account suspension.
8. Platform's Role
Blysko does not employ or manage Specialists. We are not a party to any service agreements between Clients and Specialists.
Blysko is not liable for disputes, damages, or issues arising from services rendered.
Services provided by Blysko
Blysko makes the software with the respective selected service plans available to its customers for use over the internet, and renders further related services such as website development as well as hosting/operation. Blysko's Services consist of particular service plans which the Specialist can order individually over the website or in another form from Blysko.
Support
Blysko shall provide support to assist its customers with technical issues related to the use of its Services. The level of support depends on the chosen Subscription plan that is defined under Support item. The applicable support hours can be found in Support item. Our support is not available on statutory holidays. The time until the first response to email enquiries may vary depending on subscription plan. Blysko shall make every effort to react within a reasonable period of time. Enquiries received outside of regular support hours shall be deemed to have been received during the next business day. The support shall not include: general advice or training on marketing or legal advice. Technical support for websites of the customer shall only be provided in the context of chosen subscription level.
Services provided by third parties
Blysko may employ third parties for the Service performance at its sole discretion; e.g. for the hosting of websites and apps, payments operations, sending SMS and emails, and for online services to develop/provide apps.
9. Use of the Platform
Specialist agrees not to:

Use the platform for unlawful purposes;

Impersonate another user or entity;

Post false, misleading, or harmful content;
-
Interfere with platform functionality or security.
10. Intellectual Property
Platform Ownership
All software, code (including source code), design files, architecture, documentation, and related materials developed for or on behalf of Blysko are and shall remain the sole property of Blysko. This includes but is not limited to the website, web or mobile applications, widgets, scheduling systems, and any other software or technical assets.
Specialist Content
Each Specialist retains ownership of the content they upload to the platform, including but not limited to profile information, service descriptions, images of past work, and availability data. By uploading such content, the Specialist grants Blysko a license to display and use this content for the purposes of providing the platform's services.
11. Termination
Blysko may suspend or terminate accounts at any time for breach of these Terms. Specialists may delete their account at any time by sending an email to support@blysko.com.
12. Liability & Disclaimers

Blysko does not guarantee the availability, quality, or outcome of services booked through the platform.

To the extent permitted by law, Blysko disclaims all liability for any damages arising from your use of the platform.
13. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the competent courts of canton Thurgau, Switzerland.
14. Changes to the Terms
Blysko may update these Terms from time to time. You will be notified of material changes. Continued use of the platform after changes means you accept the new Terms.
